Article 1 - Definitions

In these terms and conditions the following terms shall have the following meanings:

Reflection period: the period within which the consumer can exercise his right of withdrawal.
Consumer: the natural person who does not act in the exercise of a profession or business and who enters into a distance contract with the entrepreneur.
Day: calendar day.
Duration transaction: a distance contract relating to a series of products and/or services, the supply and/or purchase obligation of which is spread over time.
Durable medium: any instrument which enables the consumer or entrepreneur to store information addressed personally to him in a way accessible for future consultation and unaltered reproduction of the stored information.
Right of withdrawal: the option for the consumer to cancel the distance contract within the cooling-off period.
Model form: the model withdrawal form that the entrepreneur makes available to the consumer.
Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers.
Distance contract: an agreement concluded between the consumer within the framework of a system organised by the entrepreneur for the distance sale of products and/or services, whereby up to and including the conclusion of the agreement exclusive use is made of one or more techniques for distance communication.
Distance communication technology: a means by which a contract can be concluded without the consumer and the entrepreneur being present in the same room at the same time.
General Terms and Conditions: these General Terms and Conditions of the entrepreneur.
Installation Service/Installation Service: a service offered by DeAutoUnie or purchased by the consumer consisting of (having) installed, connected, configured or otherwise made ready for use of products in or on the consumer's vehicle.

Article 3 - Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and orders concluded between the entrepreneur and the consumer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If this is not reasonably possible, the consumer will be informed before the distance contract is concluded that the general terms and conditions are available for inspection at the company and that they will be sent free of charge upon request.

If the agreement is concluded electronically, the conditions will be made available electronically in a way that enables storage on a durable data carrier.

If one or more provisions of these terms and conditions are null and void or annulled, the remaining provisions will remain in full force.


Article 4 - The offer

The offer contains a complete and accurate description of the products and/or services offered. Obvious errors or mistakes are not binding on the entrepreneur.

Each offer contains information about:

  • the price including taxes;

  • any shipping costs;

  • the manner in which the agreement is concluded;

  • whether or not the right of withdrawal applies;

  • the method of payment, delivery and execution;

  • the period for accepting the offer.

Product images are a true representation of the products offered. However, DeAutoUnie cannot guarantee that the colors shown correspond exactly to reality.


Article 5 - The Agreement

The agreement is concluded at the moment the consumer accepts the offer and meets the conditions set.

If the agreement is concluded electronically, DeAutoUnie will immediately confirm receipt of acceptance of the offer electronically.


Article 6 - Right of withdrawal

Upon delivery of products

The consumer has the right to cancel the agreement without giving any reason within 14 days after receiving the product.
During this period, the consumer must handle the product and packaging with care. If the right of withdrawal is exercised, the product must be returned with all accessories and – if reasonably possible – in its original condition.

When providing services (installation/fitting-in)

For services, the consumer also has a 14-day reflection period from the moment the agreement is concluded.
If the consumer expressly requests immediate performance of the service within this period during the ordering process, he acknowledges that the right of withdrawal expires after full performance of the service.

If the service has been partially performed and the consumer decides to cancel, the consumer is liable for a proportionate compensation for the work already performed.


Article 7 - Costs in case of revocation

If the consumer exercises his right of withdrawal, only the costs of return will be at his expense.

DeAutoUnie will refund the purchase price of the products as soon as possible, at the latest within 14 days after receipt of the returned product.
No refund will be made for fully completed installation services, unless the consumer has expressly agreed in advance to the execution within the cooling-off period.


Article 8 - Exclusion of the right of withdrawal

The right of withdrawal is excluded for:

  • Products that have been manufactured or modified according to consumer specifications;

  • Products which by their nature cannot be returned;

  • Hygiene products where the seal has been broken;

  • Services that have been fully performed with the express consent of the consumer within the cooling-off period.


Article 9 - The price

All prices include VAT and are subject to printing and typographical errors.
Price increases within 3 months of purchase are not permitted, unless required by law.


Article 10 - Conformity and warranty

DeAutoUnie guarantees the quality of products and services supplied.
Any defects or incorrectly delivered products must be reported within 2 months of delivery.

The warranty expires in the event of:

  • improper use;

  • damage caused by third parties;

  • self-carried out repairs or adjustments.


Article 11 - Delivery and execution

Delivery will take place at the address specified by the consumer.
DeAutoUnie aims to deliver within 30 days of ordering, unless otherwise agreed.

The following applies to installation services:
The consumer must make the vehicle available on the agreed date.
If necessary for correct installation, DeAutoUnie may make minor adjustments. Any additional costs will be discussed in advance.


Article 12 - Duration transactions: duration, termination and extension

For contracts of indefinite duration, a notice period of up to one month applies.
Fixed-term contracts can be terminated at the end of the term with the same term.
Extension never takes place tacitly, unless permitted by law.


Article 13 - Payment

Payment must be made within 7 working days after the start of the cooling-off period.
In the event of non-payment, DeAutoUnie reserves the right to charge statutory interest and collection costs.


Article 14 - Complaints procedure

Complaints must be reported in writing within 2 months of detection via info@deautounie.com .
The consumer will receive a response within 14 days.
If the complaint is not resolved by mutual agreement, the consumer can contact Stichting WebwinkelKeur or the European ODR platform ( http://ec.europa.eu/odr ) .


Article 15 - Disputes

Agreements between DeAutoUnie and the consumer are exclusively governed by Dutch law.
The Vienna Sales Convention does not apply.


Article 16 - Additional or deviating provisions

Additional provisions may not be to the detriment of the consumer and must be recorded in writing.

Installation service approval:
During the ordering process, the consumer expressly declares, if applicable, that he or she agrees to the immediate execution of the installation service within the cooling-off period and acknowledges that the right of withdrawal expires once the service has been fully performed.
